Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
On 29th March 2025, the Worker referred the present dispute to the Commission. Following the Employer’s failure to object to the same within the statutory timeframe, a hearing in relation to these matters was convened for 10th October 2025. This hearing was held in person in the Commission’s Carlow offices. There was no appearance by or on behalf of the Worker at the hearing as scheduled. After allowing a period of time to elapse to account for lateness, the matter proceeded in their absence. |
Summary of the Worker’s Case:
As set out above, there was no appearance by or on behalf of the Worker. Having reviewed the file it is apparent that the Worker was informed of the time, date and venue of the hearing in the normal manner. Given that no application for adjournment was received in advance of the hearing, and no explanation was received thereafter, the below decision is issued in consideration of the Employer’s position only. |
Summary of the Employer’s Case:
The Employer attend the hearing with the relevant witnesses and documentation to defend the allegations raised by the Worker. While the Employer stated that they were ready to meet the allegations on their merits, they submitted that in the absence of the Worker, the matter should fail. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
As set out above, the Worker did not attend the hearing. In these circumstances I find that the Worker has not pursued the dispute, and I do not recommend in his favour. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I do not recommend in favour of the Worker.
